Breaking News: “Saggy Pants” Granted a Reprieve

The Tennessee Attorney General just released an Opinion about a proposed bill which would make wearing “saggy pants” a crime.  The Opinion is attached.  In particular, it would be a Class C Misdemeanor to “knowingly wear pants below the person’s waistline, in a public place, in manner that exposes the person’s underwear or bare buttocks” if the bill is passed. 

The Attorney General opined that this proposed bill is too vague regarding what the law prohibits, and it does not provide specific guidance for law enforcement.  There are also substantive due process and First Amendment concerns.  It looks like, unless this bill is re-worked, Tennessee will fail to be the first state to enact such a statute.
